News - Incoterms 2010 to 2011 - Exporter's Portal - Brazil

There are a few months, we reported that the pregnancy was in Incoterms 2010 in Paris.Even here, as the Brazilian Committee had representatives. This time Brazil participated in the review. A small team with only two representatives, we're the other half. Our team helped make a good job.

As practically everyone knows, the review was completed, approved, and after adjustments was published in setembro/10. Enter into force on 01/01/11. The Brazilian Committee has provided its import for sale in Brazil. According to informed, this time a translation into Portuguese will be made by determination of the ICC - Paris, Portugal.

He was further simplified, considering the terms available. Are now only 11 terms. Disappeared four of the five terms of group "D" of Incoterms 2000 and entered two new ones.

Cease to exist the terms DAF, DES, DEQ and DDU. The add also our first suggestion. And good riddance, because in our opinion was of no use. In fact, he even represented the group "D" for delivery. Actually would be better as belonging to the "F", named FFA (Free at Frontier). The very preamble of DAF in Incoterms 2000 reads: "Delivered at Frontier That means the seller Delivers When The goods are at the disposal Placed of the buyer? at the named point and place at the frontier, But before the Customs border of the adjoining country. " If the debt is before customs of the country adjacent, then there is the delivery group, but group "F", similar to the FCA (Free Carrier). "

Come into their places two new terms, much more clear and objective. DAT (Delivered at Terminal), in which the goods are delivered to a terminal, and DBH (Delivered at Place), in which the merchandise is delivered to a place other than a terminal. Thus, the group "D" shall be composed of only three terms, where the two join the new DDP preserved.

DAT comes to replace the DEQ (Delivered Ex Quay), in which the goods are delivered to the carrier vehicle landed. DAP enters replacing the terms DAF, DES, and DDU, where the goods are delivered available to the buyer, ready to be unloaded from the carrier vehicle. Both placements Incoterms 2010 itself.

DAT in the goods may be delivered to a port terminal in this case as to who replaces the DEQ, or a terminal outside the port.

In DAP the goods can be delivered to port, still on the ship, without being landed in this case as its predecessor DES. Or anywhere else, such as DAF and DDU.

These two new terms, of course, facilitate transactions. First because they are clearer, and proof is confusing the DAF. Second, we now have fewer terms, and more comprehensive. And in particular, for their transparency. DAT with delivery at a terminal and a terminal outside of DAP, even within a vessel.

Another, very good and necessary, and facilitates the delivery operation and understanding of the instrument is in relation to the good old terms FOB, CFR and CIF. The goods delivery is no longer on the railing of the ship (ship?s rail), or in the airspace of the ship to be delivered "on-board (on board)."

It is also recommended that the place or port of delivery is named and defined as precisely as possible. A good example, according to Incoterms 2010 itself, is "FCA 38 Cours Albert 1er, Paris, France, Incoterms 2010". In order to leave no doubt as to the precise site of delivery.

Under EXW, FCA, FAS, FOB, DAP, DAP and DDP, the named place is where the delivery occurs and risk transfer to the buyer. Under CPT, CFR, CIF and CIP, the site differs from the named place of delivery. The site is named that as far as shipping is paid. The place of delivery, with transfer of risk, that is designated by the parties in the country of the seller.

As for modes, we have the group that can be used with any of them and the group that can only be employed in water transportation (sea, river and lake). In the first group are the terms EXW, FCA, CPT, CIP, DAP, DAP and DDP. The second group are the terms of FAS, FOB, CFR and CIF.

The Incoterms 2010 formally recognizes that it can be used for application in both the domestic and international contracts. Using the internal market becomes easier when the company understanding their resolve to sell their goods abroad, practicing the trade.

Incoterm Each has a guidance note, which we call the preamble. Strangely in this current review, unlike the Incoterms 2000, she says that this guide is not part of Incoterms 2010, even though it, and that is only for guidance in selecting the appropriate word. Protested about this in vain.
